These Terms and Conditions (“Terms”) govern your access to and use of the website operated by Forever Home Oregon (“Forever Home Oregon,” “we,” “us,” or “our”) and the home safety, fall prevention, and aging-in-place advisory services we offer (collectively, the “Services”). By accessing our website or engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use our website or Services.

1. About Our Services

Forever Home Oregon provides home safety evaluations, fall prevention guidance, aging-in-place consulting, and related advisory recommendations. Our Services are informational and advisory in nature. We are not a licensed medical provider, contractor, architect, or engineer unless expressly stated in a separate written agreement.

Our recommendations do not constitute medical, legal, financial, or professional construction advice. You are responsible for evaluating our recommendations and for engaging appropriately licensed professionals (such as contractors, electricians, or healthcare providers) to perform any work or provide any care.

2. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use our Services. If you are engaging our Services on behalf of another person (such as a family member), you represent that you have the authority to do so.

3. Service Agreements, Contracts, and Waivers

Specific Services may require you to sign a separate service agreement, waiver, or release. We use electronic signature tools to facilitate these agreements.

•    Electronic signatures. By signing electronically, you agree that your electronic signature is the legal equivalent of your handwritten signature and is binding under the federal E-SIGN Act and the Oregon Uniform Electronic Transactions Act (ORS Chapter 84).

•    Waivers and releases. Any waiver or release you sign is incorporated into these Terms. Where the terms of a signed service agreement conflict with these Terms, the signed agreement controls for that engagement.

•    Recordkeeping. We retain electronically signed documents as records of our agreement with you.

4. Scheduling, Fees, and Payment

Fees for Services are described at the time of booking or in your service agreement. If you make payments through our website, you agree to the following:

•    Payments are processed by a third-party payment processor. We do not store full payment card numbers on our servers.

•    You represent that you are authorized to use the payment method you provide.

•    Fees, deposits, cancellation terms, and refund eligibility are as stated at the time of purchase or in your service agreement.

Unless otherwise stated in writing, fees are non-refundable once Services have been rendered.

5. Cancellations and Rescheduling

Cancellation and rescheduling terms, including any applicable notice periods or fees, will be provided at the time of booking or in your service agreement. We reserve the right to reschedule appointments due to weather, safety, or other circumstances beyond our reasonable control.

6. Your Responsibilities

•    Provide safe, reasonable access to the areas of your home being evaluated.

•    Disclose known hazards, structural issues, or conditions relevant to a safe evaluation.

•    Make your own decisions about whether and how to implement our recommendations.

•    Obtain any permits or professional services required to carry out recommended modifications.

7. Disclaimer of Warranties

The Services and our website are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Forever Home Oregon disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our recommendations will prevent any injury, fall, accident, or loss, or that our website will be uninterrupted or error-free.

Home safety is affected by many factors outside our control, including how recommendations are implemented and changes in a resident’s health or behavior. We cannot and do not guarantee any particular safety outcome.

8. Limitation of Liability

To the fullest extent permitted by Oregon law, Forever Home Oregon and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, arising out of or relating to your use of the Services or website.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Services will not exceed the amount you paid to us for the specific Service giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless Forever Home Oregon and its owners, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your implementation of (or failure to implement) any recommendation.

10. Intellectual Property

All content on our website, including text, graphics, logos, assessment materials, and reports, is the property of Forever Home Oregon or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent, except that reports we prepare for you may be used for your own personal, non-commercial purposes.

Our website or recommendations may reference third-party products, contractors, or services. We provide these for convenience only and do not endorse or assume responsibility for any third party. Your dealings with any third party are solely between you and that third party.
